OSEP Required Corrective Action Plan (CAP)

After a recent monitoring conducted by the Office of Special Education Programs (OSEP) CDE was notified that Colorado’s procedures governing the calculation of Proportionate Share Funds for 3- to 5-year-olds is not in compliance with the requirements of IDEA. As a result, the state is required to engage in a corrective action plan (CAP) to remedy the noncompliance. As part of the CAP ordered by OSEP, each AU in the state must recalculate Proportionate Share funds for the 3-to-5-year-olds using the best available data beginning with 2019 through 2023.

FAQ for OSEP Corrective Action Plan for Proportionate Share Determination for 3-to-5-Year Olds

IMPORTANT DEADLINES

CDE must provide evidence to OSEP that all AUs have participated in this CAP and, when needed, have adjusted their proportionate share set aside funds based on updated data beginning with the 2019-20 school year. Any additional funds to be set aside based on this adjustment must be included in the AU’s upcoming 2025-26 budget. Below are important dates that AUs will need to be aware of:

December 1, 2024 – Recommended Deadline for the Completion of Consultation with Private School within the AU’s geographic boundaries.

February 28, 2024 – All AUs must submit AU Proportionate Share Calculation Form and AU Consultation Forms.
